1. Introduction
These Terms of Service (the "Terms") govern the access and use of ReCardEx — an AI platform for generating professional product photos for marketplaces, available at recardex.com (the "Service").
By using the Service (including registration, payment, or simply browsing the site), you confirm that you have read these Terms and the Privacy Policy, and you accept them unconditionally. If you do not agree, please stop using the Service.
2. Definitions

3. Registration and Account
3.1. Access requires registration via email, Google, or other available methods.
3.2. You agree to provide accurate information. You are responsible for the security of your credentials.
3.4. Minimum age for use is 18 years.
4. Services
4.1. ReCardEx provides AI tools for visual material generation.
4.3. Services are provided on a 100% prepayment basis.
4.4. We may use third parties (subprocessors). List: recardex.com/legal/subprocessors.
5. Payments and Refunds

6. Intellectual Property
6.1. Rights to uploaded Content remain with you.
6.2. Rights to generated results transfer to you upon creation. You can use them for any commercial purpose.
6.3. Product photos, model references, environment references, prompts, and generated results are User Content or Generation Results. You confirm that you own them or have the permissions, releases, and consents required to upload them and publish the generated output, including consent from any depicted person.
6.4. Indemnification: You agree to indemnify and hold harmless ReCardEx from any claims, damages, or legal actions (including copyright, trademark, or privacy infringement) arising from the User Content you upload or the Generation Results you create.
7. Prohibited Content
No child pornography, violence, extremism, or copyright infringement.
Do not use the Service for impersonation, deceptive use of another person's likeness, non-consensual identity use, harmful or sexualized content, or any attempt to mislead viewers about a person's endorsement, presence, or participation.
8. AI Disclaimer
8.1. AI generation is probabilistic. No 100% accuracy guaranteed.
8.2. Service is provided "as is".
9. Limitation of Liability
To the maximum extent permitted by law, ReCardEx shall not be liable for any indirect, incidental damages, data loss, or lost profits. Our total aggregate liability for any claims is strictly limited to the amount you paid us for using the Service in the past 12 months.
10. Termination
We reserve the right to suspend or permanently terminate your account at any time, without prior notice and without a refund, if you violate these Terms (including uploading prohibited content or API abuse).
11. Changes to Terms
We may periodically update these Terms. In the event of significant changes, we will notify you via email or a notice on the site. By continuing to use the Service after the changes take effect, you agree to the new Terms.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA. Any disputes arising in connection with the use of the Service shall be resolved exclusively in the courts of the State of Florida.
